SPECIAL HARDSHIP ORDER licences

The consequences of losing your driver’s licence can be financially disastrous.   A special hardship order allows you to continue driving if your licence is suspended by the Department of Transport.  There are circumstances conditions which must first be met for you to have the right to apply to the Court for a Special Hardship Order allowing you to stay on the road.

 

The conditions include that you must:

  • Have held a valid Queensland licence immediately before the driving suspension took effect;
  • Not have had your licence disqualified, suspended, or cancelled in the last 5 years; and
  • Not have not been convicted of dangerous operation of a motor vehicle in the last 5 years

If the above conditions are met, then we can make an application for you to be granted a Special Hardship Order and the Court will grant a licence if we successfully argue that:

 

  1. You are a fit and proper person to continue to drive (having regard to your traffic history and the safety of others and the public); and;
  2. A refusal would either:
  3. Cause extreme hardship in that you would lose your ability to earn a living; or
  4. Cause severe and unusual hardship to you or your family for reasons not related to earning a living.

An example of the second category includes matters such as taking a sick family member to hospital appointments.  With each individual applicant’s position being different it is advisable to call us to discuss your circumstances and prospects.

With there being limited time within which to make the application (which must include supporting affidavits and the like), you should contact us as soon as you receive the letter from Queensland Transport.
